CONSENT AND DECLARATION NOTICE FOR CONTENT CREATORS
1- Commitments
I declare and undertake that I give my personal consent, unlimited in time and irrevocable for global use, to Evly Pharma Kozmetik Sanayi ve Ticaret Anonim Şirketi, the manufacturer and owner of The Purest Solutions brand products, regarding the use of the social media content I have produced and will produce, with respect to the usage rights listed below, and that I have transferred these rights to Evly Pharma Kozmetik San. ve Tic. A.Ş.
- Commercial Use Right
- Right of Use
- Advertising Use Right
- Outdoor Use Right
- Indoor Use Right
- Right to Edit / Compile (Edit Right)
- Global Use Right
- Cross-Platform Publication Right
- Right to Transfer to Third Parties / Sub-license
- Storage and Archiving Right
- Processing of my personal data within the scope of the KVKK Privacy Notice
- Processing of facial and voice recognition data within the scope of the KVKK Privacy Notice
I declare and undertake that the rights listed above belong to me, that Evly Pharma Kozmetik San. ve Tic. A.Ş. will not suffer any loss on account of my having previously transferred these rights to other persons and institutions, that I am aware of the information and my legal rights regarding the transfer of these usage rights, and that I know and accept the terms of the commercial relationship I have with Evly Pharma Kozmetik San. ve Tic. A.Ş. in this regard.
2- Privacy Notice and Explicit Consent Statement under the Law No. 6698 on the Protection of Personal Data
A. Privacy Notice
Within our Company Evly Pharma Kozmetik Sanayi ve Ticaret A.Ş., for the final evaluation of our Company's products and, following this evaluation process, for reporting, R&D, corrections and finalizing the Company's products accordingly, and in connection with the final versions of the Company products you will use and the information you will report and send to the Company about these products, the following personal data of yours will be processed by the Company:

- Contact Information
- Address Information
- Social Media Account Information
- Health Data
- Biometric Data
Pursuant to the provisions of Law No. 6698 on the Protection of Personal Data, our Company, as the "data controller", will record, classify, process, store and update the personal data you provide and, where permitted by legislation, may disclose it to third parties; we hereby inform you about our mutual rights and obligations under this legal regulation.
a) Data Controller
Under Law No. 6698 on the Protection of Personal Data, the "data controller" is our Company, Evly Pharma Kozmetik Sanayi ve Ticaret A.Ş.
b) Purposes and Legal Grounds for Processing Personal Data
Your personal data above, which you have provided in connection with the marketing and promotion of our Company's products, the planning of collaborations with you, R&D, reporting, corrections and the sale of the Company's products, will be processed within our Company for the following purposes:

Your personal data, for the purposes listed below that are the subject of your disclosure to the Company, may be processed within the framework of the personal data processing conditions set out in Articles 5 and 6 of the Law, in accordance with the conditions and principles in Article 4 of the Law: (a) being lawful and fair, (b) being accurate and, where necessary, up to date, (c) being processed for specified, explicit and legitimate purposes, (d) being relevant, limited and proportionate to the purposes for which they are processed, (e) being retained for the period stipulated in the relevant legislation or necessary for the purpose for which they are processed.
c) Transfer of Personal Data and Purposes of Transfer
Your personal data above, which you have provided in connection with the marketing and promotion of our Company's products, the planning of collaborations with you, R&D, reporting, corrections and the sale of the Company's products, excluding your special category data, may be transferred by our Company to the following persons for the purposes listed above:

d) Method of Collection and Legal Grounds for Personal Data
Your personal data above, which you have provided in connection with the marketing and promotion of our Company's products, the planning of collaborations with you, reporting, R&D, corrections and the sale of the Company's products, is collected by our Company only through this form and in digital form, for the purposes listed above.
e) Rights of the Data Subject
By applying to our Company, you have the right to: learn whether your collected personal data is being processed, request information if it has been processed, learn the purpose of processing and whether it is used in accordance with that purpose, know the third parties to whom it is transferred domestically or abroad, request correction if it has been processed incompletely or inaccurately, request deletion or destruction of personal data within the framework of the conditions set out in Article 7 of the said Law, request that the actions taken regarding the above-mentioned correction, deletion or destruction be notified to the third parties to whom it has been transferred, object to the emergence of a result against you through the exclusive analysis of your data by automated systems, and request compensation for damages if you suffer harm due to unlawful processing.

B. Explicit Consent Statement of the Data Subject
Within the framework of the information provided to me in Article A above, I declare that I give the special category personal data processed within the scope of this entire text of my own free will; I accept and declare that I give my explicit consent to the use and recording of the special category personal data I have provided by the Company for the purposes stated above and to their transfer domestically or abroad for these purposes, and to the storage, recording and sharing with third parties of my personal contact details within the terms of this consent statement, that I have learned all my rights, including the right to request information regarding the processing and protection of my personal data, and that I have been informed that I may exercise my rights at any time in accordance with the Law by applying to the data controller.
